If you think any information on the website about you is not relevant to you or you find any wrong data on our website or you feel any unauthorized access or activity through your Pakdial account, please inform or notify Pakdial immediately. Pakdialwill not be responsible for any such action by you.

In all such cases, we will not be accountable to any party for any direct, indirect, special, or other consequential damages, including, without limitation, any lost profits, business interruption, or otherwise.

May allow User(s) access to content, products or services offered by third parties through hyperlinks (in the form of word link, banners, channels or otherwise) to the websites offered by such third parties (“Third Party Websites“). advises its User(s) to read the terms and conditions of use and/or privacy policies applicable in respect of such Third Party Websites prior to using or accessing such Third Party Websites.  Fees and Payments

By listing Business/Product or Services, you agree to pay Pakdial monthly or quarterly or yearly subscription/Registration fees. Payments will be due as of the first day you sign up for Business or Products.

Configurations and prices of the Website, Products, and/or Services are subject to change at any time, and Pakdial shall at all times be entitled to modify configurations, fees, prices and quotations, provided that no price changes shall be made applicable to you during a subscription term, and shall only take effect after Pakdial and you have agreed upon an extension, upgrade or renewal of the subscription term. All prices are exclusive of, and you shall pay all taxes, duties, levies or fees, or other similar charges imposed on Pakdial or yourself by any taxing authority related to your order. In case of changes in the law such that a tax is levied that is or becomes irrecoverable with a consequent increase to the costs to Pakdial of delivering the Services, whereby and to such an extent Pakdial is entitled to increase its prices accordingly and retroactively.

Termination

You may terminate your agreement and close your account with Pakdial at any time, effective the last day of your subscription term, by sending an email to (support email need to be added). Pakdial may terminate its relationship with you, or may terminate or suspend the accessibility to the Website, Products, and/or Services at any time, including the use of any software, 1. if you breach these Terms and/or any other agreement with Pakdial; 2. if Pakdial reasonably suspects that you are using the Website, Products, and/or Services to breach the law or infringe third party rights; 3. if Pakdial reasonably suspects that you are trying to unfairly exploit or misuse Pakdial’s policies; 4. if Pakdial reasonably suspects that you are using the Website, Products, and/or Services fraudulently, or that Products or Services provided to you are being used by a third party fraudulently; 5. if you fail to pay any amounts due to Pakdial; 6. you violate any applicable law or regulation. Upon termination of your Pakdial account for the above reasons, there will be no refund of fees and you will be denied access to the Website, Products and/or the Services, including all of its data.

Pakdial may terminate any agreement and access to your account, if the Services or any part thereof, are no longer legally available in your jurisdiction, or are no longer commercially viable, at Pakdial’s sole discretion. 

If you believe that Pakdial has failed to perform or the Services are defective, you must notify Pakdial in writing and allow fourteen (14) days for Pakdial to cure the defect. If Pakdial cures the defect within this cure period, Pakdial will not be in default and cannot be held liable for any damages and/or losses in connection to such default. If Pakdial has not cured the defect within this cure period, you may terminate the subscription with immediate effect, upon written notice to Pakdial.

Changes

The configurations and specifications of the Website, including without limitation all content there available, the Products, and the Services may be amended and/or updated from time to time, at the sole discretion of Pakdial. You are bound by any such changes or updates unless such changes materially diminish the functionality and value of the Website, Products and/or Services.

Limitation of Liability of Pakdial, its Suppliers and its Licensors

Under no circumstances shall any party, its subsidiaries and affiliates, their respective directors, officers, employees or agents, and other representatives, be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to lost profits and business interruption, whether in contract or in tort, including negligence, arising in any way from the use of the Website, Products, Services, and/or the Contents thereof, or of any hyperlinked website even if such party is expressly advised of the possibility of such damages. With the exception of damages related to legally proven or admitted intellectual property infringement caused by Products and/or Services as delivered by a party without any third party content, in no event shall a party’s liability exceeds the total sums received by Pakdial from you during the twelve (12) month period immediately prior to the date the damages first occurred.

Your Representations and Warranties

You represent and warrant that your use of the Website, Products, and/or Services will be in accordance with any agreement between you and Pakdial, the Pakdial Privacy Policy, these Terms, and with any applicable laws and regulations, including without limitation any local laws or regulations in your country, state, city, or other governmental areas, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the country in which you reside, and with any other applicable policy or terms and conditions.

Miscellaneous

• Headings for any section of the Agreement are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
• Failure to enforce any right or failure to act with respect to any breach by a User(s) under the Agreement and/or Privacy Policy will not be deemed to be a ’s waiver of that right or ‘s waiver of the right to act with respect with subsequent or similar breaches.

• Pakdial shall have the right to assign its obligations and duties in this Agreement and in any other agreement relating ’s Services to any person or entity
• If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions of the Agreement shall be enforced.
• All calls to PakDial are completely confidential. However, your call may be recorded to ensure the quality of service. Further, for training purposes and to ensure excellent customer service, calls from PakDial may be monitored and recorded.
• Miss Mahwish is the designated Grievance Officer in respect of ’s Services. Any complaints or concerns with regards to any content on ’s Services or any breach of this Agreement or Privacy Policy can be directed to the designated Grievance Officer in writing at 103 D, Broadway Commercial DHA Phase 8, Lahore, Pakistan or through an email signed with the electronic signature sent to grievances@PakDial.com
• The Agreement and the Privacy Policy constitute the entire agreement between the User(s) and with respect to access to and use of the Web Site, superseding any prior written or oral agreements in relation to the same subject matter herein

Big buyer (“bb”) terms of use

• Under BB banner shall develop a microsite for the User(s) company (“BB Company“) on the Web Site. shall display all the leads of the BB Company on the microsite, to enable the BB Company to find out suppliers in a short period of time.BB Company hereby grants the right to use its intellectual property on the microsite and Web Site in relation to the requirements posted by the BB Company on Web Site. It is clarified that all intellectual property rights in the logos, brands and trademarks of the BB Company used in relation to the above shall vest in the BB Company only.
• BB Company shall ensure that the contents provided to shall not contain any material which is offensive, derogatory, explicit or perverse to any specific race, gender or class of persons or degrading to public conscience or morals and does not breach any applicable law.
• makes no representations or warranties to BB Company with respect to services provided by under BB banner.
• Pakdial hereby disclaims all warranties express and implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the services provided by under the BB banner.
• In no event shall be liable to BB Company for any special, exemplary, indirect, incidental, consequential, punitive damages or for any damages arising out of or in connection with respect to the above-mentioned service.
• Apart from the said terms & conditions, the Agreement shall be deemed to form part and parcel of BB terms and conditions.

Pakdial shall not be responsible for any information, content or material in respect of or related to any pharmaceutical product posted, provided or displayed by User(s) on the Web Site. Accordingly, the user posting the content shall ensure that the content so posted does not violate any statue in the rules made thereunder including the Act(s) as referred above, so that no consequences of any nature could be attributed to in any manner whatsoever.

Users(s) hereby undertake that they shall solely be responsible and shall bear all the liabilities in respect of selling prescription medicines and/or drugs mentioned in any of the Schedules of the Drug Rules without a prescription issued by a registered medical practitioner and in accordance with the conditions laid down in such rules. In the event of a breach of such condition, shall not be liable and responsible in any manner whatsoever.

Users(s) undertake and agree to indemnify and hold harmless and/or any of its affiliates, directors, officers, employees or representatives from and against any and all losses, liabilities, damages, claims, costs and expenses (including attorney’s fees and expenses, any third party claims), which may incur or suffer as a result of or in connection with any illegal sales of drugs and/or medicines.

Pakdial does not offer any guarantees or warranties on the medicinal products or services displayed or listed on the Web Site and is not liable for any relevant transaction between the User(s), including transactions involving the sale of any medicine(s) restricted and/or banned for sale by any governmental or any other regulatory authorities.
